Hiring in Tunisia

The Labor Code in Tunisia covers regulations concerning the minimum wage, overtime work, normal hours of work, holidays, leave policies, wage payment policies, and termination pay requirements. Collective bargaining agreements have been used since 1973 and can set different standards for payment, work hours, and leave.

The current Labor Code originally entered into force in 1966 and has since been amended.

Employment contracts in Tunisia

As you look to hire employees in Tunisia, here are some standard regulations you’ll need to know to create a compliant contract, as well as how an employer of record and PEO can provide support for your unique HR needs.

Working hours

The normal workday is eight hours a day. The normal work week should not exceed 48 hours.

Employers are required to give employees one day of rest per week. Weekly rest generally is given on Friday, Saturday, or Sunday.

Work, including overtime hours, is limited to 60 hours a week.

Compensation

As you consider the appropriate salary to offer new employees, keep in mind:

  • Effective May 1, 2019, Tunisia’s monthly minimum wage for employees who work at least 40 hours but less than 48 hours per week is 344.463 and its monthly minimum wage for employees who work at least 48 hours per week is 403.104.
  • The private sector minimum wage will see a hike of 14.5% through 2025:
  • Employees who work more than 48 hours a week are entitled to 175% of normal pay for each hour worked beyond the 48th hour.

Bonuses

Tunisia does not mandate employers to provide bonus payments to employees.

Termination and severance

Employees terminated at the end of an employment contract are entitled to one day of pay per month worked. Termination pay cannot exceed a payment equal to salary for three months of service.

In the case of unfair termination, employees are entitled to one month or two months of pay for each year worked up to an amount equal to three years of salary; depending on the case of unfair termination.

Employee benefits and paid leave in Tunisia

When negotiating terms of an employment contract with a candidate in Tunisia, here are some of the statutory benefits and paid leave requirements to keep in mind, as well as how an employer of record can support your company’s benefits strategy.

Maternity leave

Employers must give women 30 days of maternity leave, which is paid by health insurance. Employees can request extensions for maternity leave for 15 days at a time.

Vacation

After a year of service, employees are entitled to paid vacation days accruing at the rate of one day per month. After five years of service, employers must give employees an additional day of paid annual leave up to a total of 18 days off per year.

Holidays

Paid holidays in Tunisia generally include the following:

  • New Year’s Day
  • Independence Day
  • Labor Day
  • Tunisian Republic Day
  • Eid Al Fitr
  • Eid Al Adha
  • Hegire (Islamic New Year)

Holidays with no specific dates listed are determined by the lunar calendar and therefore fall on different days of the Gregorian calendar each year.

Health coverage

Retirement plans in Tunisia are covered under social taxes.

Additional benefits

In addition to healthcare benefits, employees in Tunisia are entitled to pension, which is funded by government tax revenues, as well as workers compensation, which is covered through mandated employer insurance.
